Proclamation recognizing and thanking Adam Loud for his unselfish act of rescuing four swimmers from a dangerous rip current at Main Beach Park on May 15, 2013. Adam Loud, Fernandina Beach Fire Engineer, will be present to accept the Proclamation.

4.2. PROCLAMATION NATIONAL BEACH SAFETY WEEK
Proclamation proclaiming the week of June 2, 2013, as “National Beach Safety Week.” Jason Higginbotham, Fernandina Beach Fire Chief, will be present to accept the proclamation.

4.3. PROCLAMATION NATIONAL MARINA DAY IN FERNANDINA
Proclamation proclaiming June 8, 2013, as “Welcome to the Water on National Marina Day in Fernandina. Fernandina Harbor Marina Manager Joe Springer with Westrec Marina will be present to accept the Proclamation.

4.4. PROCLAMATION NATIONAL FLAG DAY & NATIONAL FLAG WEEK
Proclamation proclaiming June 14, 2013, as “National Flag Day”, and the week of June 10, 2013, as “National Flag Week.” Ms. Marie Santry, Chapter Regent of the Daughters of the American Revolution, will be present to accept the proclamation.

4.5. PRESENTATION GOLF COURSE CONDITION
Citizen Tom Shave will provide a brief report regarding the condition of the Fernandina Beach Golf Course. This item is placed on the agenda at the request of Commissioner Boner.

5.2. SCENIC HIGHWAY DESIGNATION
RESOLUTION 2013-75 REQUESTING THE FLORIDA DEPARTMENT OF TRANSPORTATION TO DESIGNATE STATE HIGHWAY A1A IN FERNANDINA BEACH FROM THE NASSAU COUNTY LINE ON S. FLETCHER AVENUE, CONTINUING ON TO ATLANTIC AVENUE TO THE NASSAU COUNTY LINE ON S. 8TH STREET/ SR 200 AS A FLORIDA SCENIC HIGHWAY PURSUANT TO SECTION 335.093, FLORIDA STATUTES; PROVIDING FOR AN EFFECTIVE DATE.
Synopsis: Requests the Florida Department of Transportation to designate State Road A1A in Fernandina Beach from the Nassau County line on S. Fletcher Avenue, continuing onto Atlantic Avenue to the Nassau County line on S. 8th Street/ SR 200 as an official state scenic highway.

7.1. BUDGET AMENDMENTS AIRPORT & LEGAL DEPARTMENT
RESOLUTION 2013-76 APPROVING AMENDMENTS TO THE BUDGET FOR THE AIRPORT AND LEGAL DEPARTMENT FOR THE FISCAL YEAR 2012-2013 BUDGET; AND PROVIDING FOR AN EFFECTIVE DATE.
Synopsis: Approves the transfer of $10,000 into the Airport Improvement account and the transfer of $5,000 into the Legal Contractual account for FY 12/13.

7.2. TASK ORDER APPROVAL OLSEN ASSOCIATES, INC.
RESOLUTION 2013-77 APPROVING TASK ORDER #2013-02 WITH OLSEN ASSOCIATES, INC. FOR THE NASSAU COUNTY SHORE PROTECTION BEACH DISPOSAL TASK; AUTHORIZING EXECUTION; APPROVING A BUDGET AMENDMENT FOR UNANTICIPATED GRANT REVENUE AND BEACH CONSTRUCTION PAYMENTS; AND PROVIDING FOR AN EFFECTIVE DATE.
Synopsis: Approves Task Order #2013-02 with Olsen Associates, Inc. for the Beach Disposal Task and a budget amendment to: increase the FDEP and Nassau County grant revenue; increase the Beach Renourishment Construction account; and transfer funds from the Capital Improvement’s reserve account.

7.3. MASTER UTILITY SYSTEM BOND
RESOLUTION 2013-78 AMENDING AND RESTATING RESOLUTION NO. 2013-44 IN ITS ENTIRETY, WHICH SUPPLEMENTED RESOLUTION NO. 2013-43 ADOPTED BY THE CITY COMMISSION OF THE CITY OF FERNANDINA BEACH, FLORIDA; PROVIDING FOR THE ISSUANCE OF NOT TO EXCEED $33,000,000 UTILITY SYSTEM REFUNDING REVENUE BONDS, SERIES 2013A, FOR THE PURPOSE OF REFUNDING CERTAIN OUTSTANDING DEBT OF THE CITY ATTRIBUTABLE TO THE UTILITY SYSTEM, FUNDING NECESSARY RESERVES, AND PAYING COSTS RELATED THERETO, SUBJECT TO THE SATISFACTION OF CERTAIN CONDITIONS CONTAINED HEREIN AND SUBJECT TO THE TERMS AND CONDITIONS OF A PURCHASE CONTRACT; APPROVING THE FORM OF THE PURCHASE CONTRACT, PRELIMINARY OFFICIAL STATEMENT, AND CONTINUING DISCLOSURE CERTIFICATE; AUTHORIZING THE EXECUTION AND DELIVERY OF AN ESCROW DEPOSIT AGREEMENT, PURCHASE CONTRACT, FINAL OFFICIAL STATEMENT AND CONTINUING DISCLOSURE CERTIFICATE; APPOINTING AN ESCROW AGENT, PAYING AGENT AND REGISTRAR; DELEGATING TO THE MAYOR THE AUTHORITY TO AWARD THE SALE OF THE BONDS TO THE UNDERWRITERS NAMED HEREIN PURSUANT TO A NEGOTIATED SALE AND SUBJECT TO THE CONDITIONS AND TERMS SET FORTH HEREIN AND IN THE PURCHASE CONTRACT; AUTHORIZING THE CITY TO OPT TO INSURE ALL, A PORTION OF OR NONE OF THE BONDS WITH A POLICY OF MUNICIPAL BOND INSURANCE AND/OR TO PURCHASE A RESERVE FUND INSURANCE POLICY, WHICHEVER IS IN THE BEST FINANCIAL INTEREST OF THE CITY; MAKING CERTAIN COVENANTS AND AGREEMENTS IN CONNECTION THEREWITH; AND PROVIDING AN EFFECTIVE DATE.

8.1. CODE AMENDMENT – ANIMAL CONTROL
ORDINANCE 2013-11 AMENDING CHAPTER 18, ARTICLE I, IN GENERAL, OF THE CODE OF ORDINANCES; AMENDING SECTION 18-4 BY PROVIDING THAT THE ANIMAL OWNER SHALL NOT ALLOW AN ANIMAL TO MAKE SOUNDS FOR MORE THAN 30 CONTINUOUS MINUTES; PROVIDING THAT IT IS UNLAWFUL TO ALLOW AN ANIMAL TO BE CONFINED IN AN UNATTENDED VEHICLE WITHOUT SUFFICIENT VENTILATION OR OTHERWISE IN CONDITIONS THAT MAY BE REASONABLY DETRIMENTAL TO ANIMAL’S HEALTH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
Synopsis: Approves amending a portion of the City Code pertaining to the standards of care and control for animals based upon a request by the Nassau Humane Society.

8.2. COMPREHENSIVE PLAN AMENDMENT – ECONOMIC DEVELOPMENT ELEMENT
ORDINANCE 2013-12 STATING ITS INTENT TO AMEND ORDINANCE 2003-36 TO ADD THE ECONOMIC DEVELOPMENT ELEMENT AND DEFINITIONS; AND APPROVING THE TRANSMITTAL OF SUCH PROPOSED AMENDMENTS TO THE STATE LAND PLANNING AGENCY FOR REVIEW IN ACCORDANCE WITH SECTION 163.3184(3), FLORIDA STATUTES.
Synopsis: Endorses the proposed Evaluation and Appraisal Report based Comprehensive Plan amendments for transmittal to the State Land Planning Agency for the purpose of a sufficiency review in accordance with Section 163.3191, Florida Statutes.
